Whether it’s congressional hearings, new cross-border data sharing legislation, or the disclosure of a major cyber breach, nearly every day brings with it another data privacy or cybersecurity headline. And this popular interest in the protection of sensitive information invariably leads to more robust regulation –in the form of lawsuits brought by an aggressive plaintiff’s bar; U.S. regulators seeking to enforce a variety of privacy, data protection, and information security standards; and international regulators applying standards that are increasingly relevant to U.S. businesses. In light of these trends, this session will provide insight into what companies should be thinking about in four main areas:
- U.S. consumer privacy and cybersecurity litigation;
- B2B disputes regarding privacy and cybersecurity obligations;
- The range of U.S. regulatory enforcement; and
- Evolving international standards, particularly in light of the European Union’s General Data Protection Regulation.
