EU AI Act: Are You Prepared for the “AI Literacy” Principle?
The EU AI Act is the world’s first horizontal and standalone law governing the commercialization and use of AI, and a landmark piece of legislation for the EU. Among the various provisions of the EU AI Act, the “AI literacy” principle is an often overlooked but key obligation which requires organizations to ensure that staff who are involved in the operation and use of AI have the necessary skills, knowledge and understanding to adequately assess AI-related risks and opportunities (e.g., through training and hiring staff with the appropriate background and skillset). This obligation – which applies from February 2, 2025 – is one of the few obligations under the EU AI Act that applies to all AI systems i.e., irrespective of the level of risk that the AI system presents. Indeed, by introducing AI literacy as one of the first provisions of the AI Act (Article 4), the EU legislators appear to underscore the significance of this requirement.
U.S. FTC’s New Rule on Fake and AI-Generated Reviews and Social Media Bots
On August 14, 2024, the United States Federal Trade Commission (FTC) announced a final rule that prohibits fake and artificial intelligence-generated consumer reviews, consumer testimonials, and celebrity testimonials, along with other types of unfair or deceptive practices involving reviews and testimonials. This new rule is the latest development in the FTC’s increased rulemaking efforts and increased focus on AI, and will take effect on October 21, 2024.
Unofficial Final Text of EU AI Act Released
On 22 January 2024, an unofficial version of the (presumed) final EU Artificial Intelligence Act (“AI Act”) was released. The AI Act reached political agreement early December 2023 (see our blog post here) and had undergone technical discussions to finalize the text since. It was reported that the document was shared with EU Member State Representatives on 21 January 2024, ahead of a discussion within the Telecom Working Party, a technical body of the EU Council on 24 January 2024, and that formal adoption at the EU Member State ambassador level (i.e. COREPER) will likely follow on 2 February. On Friday 26 January 2024, the Belgian Presidency of the Council officially shared the (analysis of the) final compromise text of the AI Act with Member State representatives – clearly indicating that this text will be put forward for adoption.
